Terms of Use

These Terms of Use ("Terms") govern your access to and use of the LAND/SPLIT platform, including the website at landsplit.net, the web application, and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

The Service is operated by Jake Vicary ("we", "us", "our"), an Australian sole trader. If you do not agree to these Terms, do not use the Service.

1. The Service

LAND/SPLIT is a property intelligence platform that analyses land parcels in Tasmania against planning schemes, zoning rules, and subdivision regulations. The Service provides indicative information about subdivision potential, lot yield estimates, planning overlays, and cost tiers.

The Service is a research and analysis tool only. Nothing on LAND/SPLIT constitutes professional planning, legal, surveying, financial, or development advice. You must obtain independent professional advice before making any development or investment decision.

2. Data Accuracy Disclaimer

Planning data on LAND/SPLIT is sourced from LIST Tasmania (© State of Tasmania) and individual council planning schemes. While we take reasonable care to keep this data current, we make no warranty — express or implied — that the information is accurate, complete, or up to date at any given time.

Planning rules change. Overlays are updated. Council decisions vary. You must independently verify all information with the relevant council and consult a registered town planner or surveyor before acting on any data provided by this Service.

To the maximum extent permitted by law, we exclude all liability for any loss or damage arising from reliance on information provided through the Service.

3. Accounts

To access paid features, you must create an account with a valid email address and password. You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us immediately at admin@prismnetworks.org if you suspect unauthorised access.

You must be at least 18 years of age to create an account.

4. Subscriptions and Billing

Paid plans are billed monthly in Australian dollars (AUD) through Stripe. By subscribing, you authorise us to charge your nominated payment method on a recurring monthly basis until you cancel.

All payments are processed by Stripe. We do not store your card details.

5. Free Tier

The free tier is subject to usage limits (currently 20 parcel views per month). We reserve the right to change free tier limits at any time with reasonable notice.

7. Intellectual Property

The LAND/SPLIT platform, including its software, scoring methodology, interface design, and content (excluding third-party data), is our intellectual property. Nothing in these Terms grants you any ownership of LAND/SPLIT's systems or methodology.

Planning data sourced from LIST Tasmania is licensed under Creative Commons Attribution 3.0 Australia (CC BY 3.0 AU) and remains the property of the State of Tasmania.

Property listing data is sourced from publicly available listings and is the property of the respective listing agents and platforms.

8. Limitation of Liability

To the maximum extent permitted by Australian law, our total liability to you for any claim arising from your use of the Service is limited to the amount you paid us in the 3 months preceding the claim.

We are not liable for any indirect, incidental, special, or consequential loss, including loss of profit, loss of opportunity, or loss of data.

Nothing in these Terms limits liability that cannot be excluded under the Australian Consumer Law.

9. Consumer Guarantees

If you are a consumer under the Australian Consumer Law, you have statutory guarantees that cannot be excluded. Nothing in these Terms is intended to limit those rights.

10. Termination

We may suspend or terminate your account at any time if you breach these Terms. You may delete your account at any time through your account settings. On termination, your right to access the Service ceases immediately.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by a prominent notice on the Service. Continued use after the effective date of updated Terms constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes are subject to the exclusive jurisdiction of the courts of Queensland.
